刑法总论-刑事惩罚篇
课程简介：刑法学中，刑事惩罚也是刑法学中不可或缺的组成部分。作为法律责任实现方式之一的刑事惩罚具有相对独立性，刑事惩罚不应该仅表现为一种剥夺权利的“恶害”，还应该具有独立的价值和适用规则。从刑罚种类来说，管制、拘役、有期徒刑、无期徒刑和死刑等主刑的性质、特征以及执行都有其限制性要求，罚金、剥夺政治权利和没收财产等附加刑也有着自身特殊之处，如何在立法上构建刑事惩罚措施并将其付诸实现，力求“罚当其罪”且不枉不纵，是人类社会永恒的命题。 刑事惩罚并不是冰冷的惩罚措施，还应该有更高要求和更丰富的内涵。理解刑事惩罚的目的，综合运用各种惩罚措施与制度，实现对犯罪人的矫正，对犯罪的应对，才是刑事惩罚的终极要义。刑事惩罚也并非为了“惩罚”而惩罚，而是为了不再惩罚而进行“惩罚”，刑期于无刑！
